Now that the Narcotics Control Bureau (NCB) has accepted that there is no case against Aryan Khan, people have argued that this clear framework shows us how bad governance has become in India. I disagree with him on two grounds. One, many others have gone through similar experiences in the past. We didn’t notice them just because they weren’t that high profile. So, I’m not sure how bad the regime has really become: it was always very bad in this regard.
And second, I think when we just focus on governance; We ignore other institutions that discredited themselves during this episode. The media behaved appallingly and irresponsibly. The judiciary needs to take a long hard look at itself. And the film industry should grieve that it has become a hare of fear from one of India’s strongest and most important industries.
Let’s start with the case itself. We now know, by NCB’s own admission, that process was violated at every stage. We know that no medicine was found on Aryan Khan. The NCB arrested him anyway, arguing that a friend of his had got into drugs. When the friend said that drugs had nothing to do with Aryan, he was ignored. No medical test was done to check that Aryan’s blood did not contain drugs. His phone was confiscated and his WhatsApp messages were read without due process. When it received some old messages that the NCB took to suggest that he may have smoked in the United States a year earlier (where it was not a crime), the NCB told the press that it had evidence that He was part of it. An International Drug Syndicate!
Then, there was a complete absence of any pretense of following the rule of law. The dodgy characters, some of them wanted by the police in other cases, were allowed to be part of the arrest process on the grounds that they were assisting the NCB officials.
